Tracy Bussel successfully argued before the Appellate Division on behalf of the City of Bridgeton in the matter of Crystal Ice-Bridgeton, LLC v. City of Bridgeton. The issue on appeal was whether the plaintiff was entitled to 24 hours' notice before portions of his fire-damaged building were demolished. The Appellate Division affirmed the granting of summary judgment as to all defendants by the trial court, finding that a Chief has the "sole authority" to direct firefighting operations at the scene of a fire, and in the matter at issue, there was no evidence the Fire Chief relinquished his statutory authority as it was undisputed that he did not declare the fire out when he called in an excavator to demolish the building. Further, the Appellate Court noted that while the certification of the Construction Code official states that he and the Fire Chief acquiesced in the demolition order, such did not negate the fact that the Chief's concurrence authorized the decision, and thus 24 hours' notice before demolition was not required. The November 13, 2012 decision of the Appellate Division has been approved for publication.
