The divorce process in New Jersey can take anywhere from a few months to over a year, depending on the level of conflict. At Gebhardt & Kiefer, our goal is to guide you through the process with your emotions and your finances intact so you can move on with your life.

The goal of any divorce is to reach a fair resolution of all of the issues between the parties, such as:

  • Achieving an equitable division of marital property. Equitable does not necessarily mean equal. Our lawyers have successfully obtained a greater than 50 percent share of marital assets for our client based on the facts of the case.
  • Determining whether or not alimony should be awarded to one of the parties. In New Jersey alimony may be awarded based on factors such as the length of the marriage, the difference in earnings, the amount of separate property each has, and the lifestyle enjoyed during the marriage.
  • Negotiating a parenting plan that is the best interests of the children. While many people assume that the mother will have primary residential custody of children, New Jersey law is gender neutral. Our lawyers have successfully obtained primary custody and expanded visitation rights for fathers.
  • Determining child support. In New Jersey, child support is determined by a formula that considers the incomes of both parents and the number of children supported.
